Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Kev3D (“the Service”), an AI-powered platform for generating Panda3D simulations, games, scenes, and related code, operated by KAADE CONSTRUCTION (“we”, “us”, or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

The Service is provided by KAADE CONSTRUCTION. You are entering into an agreement with KAADE CONSTRUCTION when you create an account or use the Service.

2. Acceptance of terms

By creating an account, subscribing to a paid plan, or otherwise using the Service, you confirm that you are at least 18 years old or have authority to bind your organisation, and that you accept these Terms and our Privacy Notice.

3. Description of the Service

Kev3D provides AI-assisted generation of code, project structures, scene descriptions, debugging suggestions, portfolio recommendations, and related content for the Panda3D engine. Output is provided on an “as is” basis for your review, testing, and modification.

4. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it updated. Notify us immediately of any unauthorised use.

5. Acceptable use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Generate, distribute, or promote illegal, harmful, fraudulent, or abusive content.
• Create deepfakes, hate speech, harassment, malware, or security exploits.
• Infringe intellectual property or other rights of any person.
• Reverse engineer, scrape, probe, or interfere with the Service’s systems.
• Resell, redistribute, or circumvent usage limits or technical restrictions.
• Attempt to jailbreak, manipulate, or misuse the AI systems.

6. AI-generated content

Kev3D uses artificial intelligence to generate output. AI output may be inaccurate, incomplete, or unsuitable for your specific use case. You are solely responsible for reviewing, testing, and validating any output before using it in production or distributing it. Output must not be relied upon as professional advice (legal, financial, medical, or otherwise) without human oversight.

You retain ownership of the prompts, project data, and other inputs you submit. We do not claim ownership of your inputs. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the output generated for you through the Service.

7. Intellectual property

KAADE CONSTRUCTION retains all rights, title, and interest in and to the Service, including its software, documentation, branding, and underlying AI models. You may not copy, modify, distribute, or create derivative works of the Service except as expressly permitted.

8. Payment and subscriptions

Paid plans are billed through our online reseller and Merchant of Record, Paddle.com. Paddle handles all payment processing, billing, tax, subscription management, cancellations, and refunds. By subscribing, you agree to Paddle’s Checkout Buyer Terms, which are available at https://www.paddle.com/legal/checkout-buyer-terms.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Subscriptions renew automatically until cancelled. You can cancel at any time through your Paddle account or by contacting support. Cancellation takes effect at the end of the current billing period.

9. Refunds

We offer a 30-day money-back guarantee. If you are not satisfied with your purchase, you may request a full refund within 30 days of your order date. Refunds are processed by Paddle. To request a refund, visit paddle.net or contact our support team.

10. Service level

We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. We may modify, suspend, or discontinue features with reasonable notice.

11. Termination and suspension

We may suspend or terminate your access if you materially breach these Terms, fail to pay amounts due, pose a security or fraud risk, or repeatedly violate our acceptable use policies. Upon termination, your right to use the Service ceases immediately.

12. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

13. Limitation of liability

To the fullest extent permitted by law, KAADE CONSTRUCTION’s aggregate liability shall be limited to the amount you paid for the Service in the 12 months preceding the claim. We shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill, except where liability cannot be excluded by law (such as fraud, death, or personal injury).

14. Indemnity

You agree to indemnify and hold harmless KAADE CONSTRUCTION and its representatives from any claims arising out of your use of the Service, your content, or your violation of these Terms.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which KAADE CONSTRUCTION is established, without regard to conflict-of-law principles. Disputes shall be resolved in the competent courts of that jurisdiction.

16. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance.
